The Department of Health and Human Services issued a policy on October 28, 2026, granting temporary permission for pharmacies to compound six unapproved peptide therapies. For consumers seeking these wellness products, the move opens a path to obtain them through regulated medical providers rather than unverified sellers.

Under the directive, federal authorities will apply enforcement discretion and refrain from penalizing state-licensed compounding pharmacies, federal medical facilities, and licensed physicians who produce the specified substances. The decision follows a July 2026 recommendation from a Food and Drug Administration advisory panel to add the six items—BPC-157, KPV, TB-500, MOTS-c, Epitalon, and Semax—to the Section 503A compounding list.

Moving Beyond the Gray Market

Health and Human Services Secretary Robert F. Kennedy Jr. indicated that the administration aims to establish a state-regulated channel through Section 503A compounders. Providing access through compliant compounders is intended to give consumers reliable safety safeguards rather than leaving them to buy peptides from unregulated gray or black markets.

To formalize the transition while permanent regulations remain under development, the Department of Health and Human Services and the Food and Drug Administration submitted an interim access policy to the Office of Management and Budget. The submission would temporarily authorize specialized compounding pharmacies to produce these peptides pending formal permanent regulations.

Advocacy organizations have also weighed in on the regulatory shift. The Partnership for Safe Medicines submitted a citizen petition urging the Food and Drug Administration to halt peptide compounding, asserting that producing them remains unlawful and carries health risks. The agency has not yet detailed how long the enforcement discretion period will last or how it plans to formally answer the petition.
